Welcome to Mainpixel LLC (“Mainpixel”, “we”, “our”, or “us”). By accessing or using our website at mainpx.com, or working with us in any capacity (including requesting a demo), you agree to be bound by these Terms and Conditions. If you do not agree, do not use our site or services.
1. Services We Provide
Mainpixel specializes in designing and developing high-converting websites for business owners. Our services may include:
New website design and development
Website updates and improvements
Ongoing care and support
Related digital services
Each project may be subject to its own written agreement or proposal.
2. Requesting a Demo
When you submit a demo request, you agree to provide accurate contact and business information. Submitting a request does not guarantee we will take on your project—Mainpixel reserves the right to accept or decline any request at our sole discretion.
3. Payment Terms
Unless otherwise stated in a separate agreement:
All projects require a deposit or full payment before work begins.
Remaining balances are due on the timeline outlined in your invoice.
Late payments may result in delays or suspension of service.
We accept payment via major credit/debit cards, ACH, or other approved methods.
4. Ownership and Licensing
Once full payment is received:
You own the final website design and content we create for you (excluding third-party plugins, stock assets, or fonts with separate licenses).
We retain the right to showcase the project in our portfolio or marketing unless you request otherwise in writing.
5. Client Responsibilities
You agree to:
Provide content, feedback, and approvals on time.
Ensure that any materials (images, text, branding, etc.) you supply do not infringe on third-party rights.
Delays in communication or missing materials may impact delivery timelines.
6. Website Performance and Guarantees
We build websites using modern best practices and technologies. While we aim to improve conversions and performance, we do not guarantee specific results such as traffic volume, sales numbers, or SEO rankings.
7. Ongoing Support & Maintenance
Ongoing care plans or support retainers are billed separately. Unless stated in writing, we are not responsible for maintenance, updates, or backups after a project is delivered.
8. Termination
Either party may terminate services at any time with written notice. Upon termination:
You are responsible for any unpaid invoices.
We may provide deliverables completed up to that point, depending on the terms of your agreement.
9. Limitation of Liability
Mainpixel is not liable for:
Loss of revenue, data, or business due to site downtime, technical issues, or delays.
Third-party service failures (e.g., hosting providers, payment processors).
Our maximum liability is limited to the total amount paid to us for the project.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
11. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on our website with the updated effective date.
